Policies and Procedures v Employment Agreements

If your policies are not consistent with your Employment Agreements they may not be enforceable.

A recent court case determined that Mighty River Power could not rely on their drug and alcohol policy because of the wording of a privacy provision in their employment agreement. Sounds crazy! But I have seen many employment agreements where clauses conflict with each other; and many more policies that contain contractual obligations that need to be in or are not consistent with the company’s Employment Agreement. Now is a good time to check yours out and make sure you don’t have such conflicts.
